When someone dies, that person leaves behind an estate consisting of assets and debts that may need to be processed through an administration of that estate.
A family member or other loved one can request to be appointed to handle the administration of a person's estate. If the deceased person had a Will, he/she named an Executor to handle the administration of his/her estate. However, if the deceased person did not have a Will, a person may apply for this role as Personal Representative, and the Court may appoint that person to handle the affairs of the estate.
It is very important to consult with an attorney to discuss whether an administration of a person's estate is necessary, and the possible alternatives to probate.
